 “Blundstone Art Contest 2024” PROMOTION 

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY APPLICABLE LAW. 

THIS PROMOTION IS IN NO WAY SPONSORED OR ENDORSED BY INSTAGRAM. 

ENTRY PERIOD: 

This “Blundstone Art Contest 2024” promotion sweepstakes (the “Promotion”) begins on July  29, 2024 at 12:00 p.m. PST, and ends August 19, 2024 at 11:59 p.m. PST, by which time all votes must be received (the “Entry Period”). 

WHO MAY ENTER: 

The Promotion is only open to individuals who are at least 16 years old at the time of entry, and are legal residents of the 50 U.S. states (or the District of Columbia). Employees, officers and directors of Blundstone USA Inc. (the “Sponsor”) and those involved in the production, development, implementation or handling of the Promotion, and each of their respective affiliates, shareholders, employees, independent contractors, agents, representatives, successors and assigns, and the immediate family members (i.e. parents, children, siblings, spouse) thereof are ineligible to enter the Promotion. By participating in the Promotion, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion. 

HOW TO ENTER: 

During the Entry Period, entrants must:

1. Create a Blundstone-themed artwork (the “Submission”).
2. Submit it to the Sponsor as a 1080 x 1080 (square) JPEG or PNG via the designated landing page linked in the @blundstoneusa Instagram bio, by 12:05 a.m. PST on August 19th, 2024.
3. A maximum of one entry per person.

Note that message and data rates apply if you use a mobile device for entry. 

By entering, each entrant warrants and represents the following with respect to their Submission: 

(a)   The entrant is the sole and exclusive owner of the Submission; 

(b)  The submission will not infringe on any rights (including, without limitation, any intellectual property rights) of any third parties; 

(c)   Any third parties appearing in the Submission have given entrant appropriate consent to be portrayed and used as permitted herein; and 

(d)  All information provided by the entrant herein is true and accurate. 

 

OWNERSHIP AND USE:

Ownership Rights: All artworks entered into the Promotion remain the exclusive property of the respective entrants. By entering the Promotion, entrants acknowledge and agree that they retain full ownership rights, including but not limited to copyright, trademark, and any other intellectual property rights, in their Submissions.

Limited License: By participating in this Promotion, each entrant grants to the Sponsor a non-exclusive, non-transferable, and revocable license to use the Submission for the purpose of administering the Promotion, including: 

(a)   displaying the Submission on organic social media only, in order to be included in the voting Instagram carousels, shared from August 20th, 2024 to August 23rd, 2024.

(b)  announcing the winners . 

Attribution: The Sponsor agrees to credit the respective entrants when displaying the Submissions, whenever feasible and customary. 

Resale and Commercial Use: The Sponsor shall not engage in any resale or commercial use of the Submissions without the explicit written permission of the respective entrants and, if applicable, any additional compensation terms as agreed upon with the entrants. 

SELECTION OF WINNERS:

The Sponsor will share its top 30 favorite Submissions via its Instagram account (blundstoneusa) for audience voting between August 20th, 2024 and midnight on August 23rd, 2024.

The odds of winning a prize depend on the number of votes received for the respective Submission during the Voting Period. 

The three (3) Submissions who have received the most votes at the end of the Voting Period will be determined to be the potential winners. The Sponsor will notify the potential winners by Instagram Direct Messages. In the event that a potential winner cannot be contacted, or is disqualified for any reason, the Sponsor will select the Submission with the next highest number of votes. If an alternate potential winner cannot be contacted or is disqualified, the applicable prize will not be awarded. The Sponsor will announce the winners via a story on its Instagram account (@blundstoneusa) and its website https://www.blundstone.com/blundstone-art-contest.  

PRIZES: 

The Sponsor will give away a total of three (3) pairs of boots to three (3) selected winners. 

The total maximum prize pool is up to $795.00 MSRP. The Approximate Retail Value (“ARV”) of each of the three (3) prizes is up to $265.00 MSRP. The Sponsor reserves the right to substitute any prize for one of equal or greater value. 

Each winner will be solely responsible for any federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, and may be required to complete and file applicable tax documents and pay taxes on the value of the prize.    

RELEASES, WAIVERS AND DISCLAIMERS: 

By entering into the Promotion, entrants agree to release, discharge and hold harmless the Sponsor and its parents, subsidiaries, affiliates, agents, and representatives and each of their respective directors, officers, employees, agents, successors and assigns (collectively, the “Released Parties”), from any and all liability, claims, losses, injuries, demands, damages, actions, and/or causes of actions whether direct or indirect, which may be due to or arise out of participation in the Promotion or any portion thereof, or the acceptance, use/misuse or possession of prizes. 

In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but, not limited to, fraud, pandemic, technical problems or other similar occurrence, the Sponsor may, in its sole discretion, suspend or cancel the Promotion, and, in its discretion, award the prizes in a random drawing from among all eligible entries received up to such time. The Sponsor reserves the right to disqualify any entrant it finds to be tampering with the entry process or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

GOVERNING LAW / LIMITATION OF LIABILITY: 

VOID WHERE PROHIBITED OR RESTRICTED BY LAW. All federal, state and local laws and regulations apply. By participating, participants agree to be bound by these Official Rules and the decisions of the Sponsor which are final and binding in all respects. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants, the Sponsor or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.
